Terms of Use

Apex tells you where the habitat is good. It does not tell you where you are allowed to be, and it does not tell you a bird is there. Both of those remain yours to establish, every time you go out.
1. The agreement
These Terms of Use are a binding agreement between you and Innovative Marketing and Sales, Inc. (d/b/a Field Armor) ("Field Armor", "we", "us"). By downloading, installing or using the Apex Hunt application ("Apex"), you accept them. If you do not accept them, do not use Apex.
Apex is also covered by Apple's Licensed Application End User License Agreement. Apple is not a party to these terms, is not responsible for Apex, and has no obligation to furnish support for it. Where Apple's agreement and these terms overlap, whichever gives you greater protection applies.
You must be old enough to form a binding contract where you live. Apex is not directed to children under 13.
2. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Apex on devices you own or control, for your own hunting and scouting. You may not:
- resell, rent, sublicense or redistribute Apex or any part of it;
- extract, scrape, bulk-export, reverse engineer, decompile or republish the habitat data — the scored coverts, stand inventories, understory readings and derived layers. That corpus is the product, assembled at substantial cost, and it remains ours;
- circumvent or attempt to circumvent any access control, entitlement check or licence gate;
- use Apex to build a competing dataset or product.
3. Boundaries, access and trespass — read this one
APEX IS NOT A LEGAL RECORD OF LAND OWNERSHIP, BOUNDARIES OR PUBLIC ACCESS, AND MUST NOT BE RELIED ON AS ONE.
The public-land, ownership, road, trail and gate information in Apex is derived from federal, state and county agency data and from OpenStreetMap. That data is generalised for mapping, updated on the agencies' own schedules rather than ours, inconsistent between agencies, and wrong at the edges often enough to matter. Parcels change hands. Easements, leases, closures, safety zones and seasonal restrictions are frequently not reflected at all. GPS position on your phone carries its own error, which in cover can be tens of metres.
The consequence, stated plainly: ground that appears public in Apex may be private, leased, posted, closed or otherwise off limits, and a boundary drawn in Apex may be in the wrong place. A road shown as open may be gated or closed. A trail shown may not exist, or may cross private land.
You are solely responsible, on every trip, for:
- determining whose land you are on before you enter it, and obtaining permission where it is required;
- observing posted boundaries, signs, gates and closures on the ground, which control over anything Apex displays;
- verifying land status against the managing agency's own official maps and records, and the county's plat and ownership records;
- knowing and following all applicable hunting, trespass, firearm, vehicle and access laws, season dates, bag limits and licence requirements, which change and which we do not track for you.
You assume all risk and all responsibility for trespass. Field Armor is not liable for any trespass, citation, fine, arrest, prosecution, civil claim, ejection, loss of licence or privileges, property damage, confiscation, dispute with a landowner, injury or other consequence arising from where you go, however you came to go there and whatever Apex displayed. Nothing in Apex is legal advice, a survey, a title determination, or permission from anyone to enter anywhere.
4. Scores are estimates, not predictions
A covert score is a habitat model's estimate, computed from public forest inventory, remote sensing and published ecology. It ranks the quality of cover. It is not a statement that game is present, a prediction of a flush, a guarantee of a successful hunt, or a substitute for your own scouting and judgement. Inventory data carries its own age and error; conditions, hunting pressure, weather and the season move animals in ways no map can see. Scores, layers and data change between releases.
5. Safety and assumption of risk
Hunting and travel in backcountry and forested terrain are inherently dangerous. They carry risk of serious injury, disability and death from firearms, terrain, water, ice, weather, exposure, wildlife, vehicles, equipment failure and getting lost. You knowingly and voluntarily assume all of those risks.
Navigation, routing, tracks and distance estimates in Apex are aids, not a substitute for a map, a compass, a charged phone, a plan filed with someone, and your own judgement. Do not follow a route into terrain, water or weather you are not equipped for. Batteries fail, signal is absent, and downloaded data goes stale. Carry what you need to get out without the app.
6. Third-party data and services
Apex incorporates data from the Michigan, Wisconsin and Minnesota Departments of Natural Resources, the USDA Forest Service, the USGS, USDA NASS and OpenStreetMap contributors, and uses third-party map imagery, geocoding, sign-in and notification services. We do not control that data or those services, we do not warrant their accuracy, currency or availability, and we are not responsible for them. Attribution and licence terms are shown in the app under Account → About & legal.
7. Your content
Your pins, journal entries, tracks, scouting reports and photos are yours. We claim no ownership of them. You grant us a limited licence to store, process and return that content only as needed to provide the features you turn on: if you enable backup, to store and restore it; if you share a spot with a crew, to deliver it to that crew. You are responsible for your content and for having the right to share anything you share.
8. Acceptable use
Do not use Apex to trespass, to take game unlawfully, to locate or pursue game in violation of any law or regulation, to harass any person or animal, or to share another person's location without their knowledge and consent. Do not attempt to extract the app's data layers, probe or disrupt our systems, or circumvent any access control. We may suspend or terminate an account that does, without refund.
9. Accounts, subscriptions and billing
An account is optional; most of Apex works without one. You can create one with Sign in with Apple, or with a Field Armor account — your email address and a one-time code we send you. Apex never asks for or stores a password. You are responsible for activity under your account.
Apex Pro is a single subscription: US$4.99 per month, covering every state Apex supports (currently Michigan, Wisconsin and Minnesota). There are two ways to buy it, and they differ only in who bills you and how long the free trial is.
On iPhone, through Apple — 14-day free trial. Sold and billed by Apple through your Apple ID. If you are eligible for the introductory offer you pay nothing for 14 days; unless you cancel at least 24 hours before the trial ends, you are then charged $4.99 and every month after that. Payment is charged to your Apple ID when the purchase is confirmed (for a trial, when the trial converts). The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel it in your Apple ID settings, not in Apex. Apple's refund policy governs refunds; we cannot issue refunds for Apple purchases.
Through Field Armor — 30-day free trial. Sold and billed by Innovative Marketing and Sales, Inc. (d/b/a Field Armor) on fieldarmorusa.com, with payments processed by Wix. A payment method is required to start the trial; you pay nothing for 30 days, then $4.99 every month until you cancel. Cancel any time in your Field Armor account on fieldarmorusa.com; cancelling stops future charges and Pro stays on until the end of the period you have already paid for. We do not give partial-period refunds except where the law requires them — write to us if something went wrong and we will make it right. To use a Field Armor subscription in the app, sign in with the same email address you used at checkout.
One free trial per person. Each trial is available once per Apple ID or once per Field Armor customer. Creating new accounts or email addresses to take repeated trials is a breach of these terms, and we may end access obtained that way.
What happens when a subscription ends. Pro features — scored coverts (PICKS), the full stand inventory (TIMBER) and Crew — lock. Nothing of yours is deleted: your journal, pins, tracks, saved coverts and scouting reports stay on your phone and stay usable, and the map and field guide keep working. Subscribing again unlocks Pro immediately.
We may change the price or what Apex Pro includes. A price change applies from your next renewal after we give notice (and, for Apple purchases, as Apple's price-change rules allow), never to a period you have already paid for.
10. Availability, changes and termination
Apex is offline-first by design, but the parts that need our server — accounts, crew, backup and downloads — depend on a service we may change, suspend, limit or discontinue at any time. We may modify or discontinue features, including data coverage for a state or region. You may stop using Apex at any time and delete your account from within the app. We may terminate or suspend your access for breach of these terms.
11. Disclaimer of warranties; limitation of liability; indemnity
Apex is provided "as is" and "as available", without warranty of any kind, express, implied or statutory. To the fullest extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, completeness, currency, reliability or availability of Apex or of any data, boundary, score, route or map it displays. We do not warrant that Apex will be uninterrupted, error-free, or that defects will be corrected.
To the fullest extent permitted by law, Field Armor and its officers, members, employees, contractors, suppliers and data providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or hunting opportunity, arising out of or relating to Apex, whether in contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility. This includes, without limitation, any claim arising from trespass, citation or prosecution; from reliance on a boundary, ownership, road, access or score displayed in Apex; from becoming lost or injured; or from the unavailability or inaccuracy of any data.
Our total aggregate liability for all claims relating to Apex is limited to the greater of (a) the amount you paid us for Apex in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars (US$50).
You agree to indemnify and hold harmless Field Armor and the people listed above from any claim, demand, loss, liability, fine, penalty or expense (including reasonable legal fees) arising out of your use of Apex, your violation of these terms, your violation of any law or regulation, or your entry onto any land.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limits above apply to you only to the extent that jurisdiction permits, and nothing here limits liability that cannot lawfully be limited — including liability for death or personal injury caused by our negligence, or for fraud.
12. Disputes — arbitration and class-action waiver
Please read this section carefully. It affects how disputes between you and us are resolved, and it limits your right to a jury trial and to participate in a class action.
Arbitration. Except as stated below, any dispute, claim or controversy arising out of or relating to Apex or these terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in the State of Michigan, or by telephone, video or on the documents at your election. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
What is excluded. Either of us may bring an individual claim in small-claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or to stop unauthorised extraction of the habitat data.
Class-action waiver. Claims may be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, then that claim — and only that claim — will proceed in court, and the rest of this section still applies.
How to opt out. You may opt out of this arbitration section, with no effect on any other part of these terms and no disadvantage to you, by emailing [email protected] with the subject line Arbitration Opt-Out and your name and the email on your account, within 30 days of first accepting these terms. An opt-out is permanent.
Try us first. Before starting an arbitration or a lawsuit, please email us at [email protected] describing the problem. Most things are faster to fix than to litigate.
13. Governing law
These terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. Subject to section 12, you and we submit to the exclusive jurisdiction of the state and federal courts located in Michigan.
14. General
If any provision of these terms is held unenforceable, it is severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between you and us about Apex. We may update these terms; material changes will be posted here with a new date, and continuing to use Apex after that means you accept them.
